ADP August: +201k

Damn, Karl is good lol, (I had to look twice after he told me.)
But depressing to, because of the absolute honesty he uses, in showing the individual pieces of the puzzle, that makes up the "big picture"

Just when I thought the silly couldn't get any more so I get a report like this.

Employment in the U.S. nonfarm private business sector increased by 201,000 from July to August, on a seasonally adjusted basis. The estimated gain from June to July was revised up from the initial estimate of 163,000 to 173,000.

Did you catch it?

The first is a statement of change.

The second is an admission that the statement is not factual; it is an estimate.

I've always known that ADP estimates employment changes because they do not handle all of the payrolls -- they extrapolate to the entire economy from their customer data, which they actually have. So their data is a count, but the extrapolation makes a number of assumptions, one of the most-important being that the ratio of firms using them to not is something they can adequately measure.

This is one of the many reasons their data is often wildly at odds with the NFP that comes out two days (or one, in the case of a holiday as was the case this month) later.

But -- did you know this? If you didn't, now you do.

In any event you have to take notice of this number as it is wildly over expectations. My best guess for tomorrow has to be ratcheted up to +125k as a consequence of it and the claims number this morning -- I was at +99k (just under 100k), so this is a fairly significant revision.

At the same time I want to note that effectively the entire gain in this report (92%) was in service jobs, and while our economy is about 70% service sector, this strongly implies that what's being created are "McJobs" that pay crap and have zero or few benefits -- that is, the common worker's standard of living is continuing its inevitable decline.

As If You Didn't Have Enough To Worry About...

If your to young to remember the McCarthy era look it up, and then substitute terrorism for communism.

During the second week of March 2012, a Dell Vostro notebook, used by Supervisor Special Agent Christopher K. Stangl from FBI Regional Cyber Action Team and New York FBI Office Evidence Response Team was breached using the AtomicReferenceArray vulnerability on Java, during the shell session some files were downloaded from his Desktop folder one of them with the name of ”NCFTA_iOS_devices_intel.csv” turned to be a list of 12,367,232 Apple iOS devices including Unique Device Identifiers (UDID), user names, name of device, type of device, Apple Push Notification Service tokens, zipcodes, cellphone numbers, addresses, etc. the personal details fields referring to people appears many times empty leaving the whole list incompleted on many parts. no other file on the same folder makes mention about this list or its purpose.

Somebody for got to mention SS#'s as well as bank accounts and any CC#'s,stock acts, used on those devices. So now anything you have done can be tracked by the jackboots of the IRS, or could be used to blackmail you into submission.
Some people actually cop a score (think buy a little weed)on those devices.

The hacker group that got the file released at least part of it.

Now here's my question -- How did the FBI obtain the file?

That's what you ought to be wondering. More to the point: Is Apple providing the FBI with every customer's registration and sale details? And if they're not -- who is?

Let's be real here folks -- 12 million UDIDs is a hell of lot of them. Are you willing to believe that there was no "official transfer" from "somewhere" to the FBI of that data?

It was a Bush era thing, that is still in application today.
Remember when all the cell companies got busted and sued for doing it, but then Bush pardoned them for it and said carry on. We need it to find the terrorists BS?
No one is above suspicion.
If I where you, I'd dump the phones, all and every kind. Go back to paying your bills by check, all that paper is so much harder for them to go through and link up. It also helps to keep your mail carrier in a job.

The Next Robo-Signing Crisis?

http://finance.yahoo.com/news/The-Next-RoboSigning-cnbc-2857229679.html?x=0&sec=topStories&pos=3&asset=&ccode=

I suppose the time has come to ask the the big question.
Where there any legal procedures followed correctly by the mortgage banking industry within the last 12 years?
Odds are no.
How bizarre is it that they used MERS to record thus bypassing the recording fees rightfully due every county that a sale was made in, and yet when it came down to foreclosure time their use of the county recorders office became imperative in order to for the notice of foreclosure sale to be published.

I have to laugh at the "light bulb moment" that CNBC now seems to be having about this issue since they seem to be a tad behind the rest of the class.
Karl Denninger and the kids over at Zerohedge as well as George over on Washington's blog have already written as well as proof read this assignment last year and received an A+ and a gold star for the actualities of what has really gone down concerning the illegalities of what the mortgage investment banks where doing and had already done.
It must be hell to have to wait on the short bus CNBC, since it's always the last to arrive.

It's the next big shoe to drop in the robo-signing foreclosure scandal. Call it part two.

We already know some banks halted foreclosure sales nationwide in October when it was discovered that servicers took short cuts, so-called "robo-signing" in the foreclosure sale process in judicial foreclosure states - about half the country.

Now it appears they may have done the same thing in a different part of the process, the Notice of Default, which takes place in the other half - i.e. the non-judicial states - this happens before the foreclosure sale.

Fraud As A Business Model Endorsed by The Fed And OCC

http://market-ticker.org/akcs-www?post=175615

Do "We" deserve this kind of representation, which comes from a government endorsed private entity?
The hand writing is on the wall kids, in big bold neon colors.
The Federal Reserve and the Office of the Comptroller of the Currency are biased toward the banks and don't represent you at all.
It's time to end the FED.
We all deserve better!

Yep.... any screwing is a good screwing, so long as a bank does it and you, the consumer, are the screwee.

WASHINGTON -- Top policymakers at the Federal Reserve are fighting efforts to rein in widely reported bank abuses, sparking an inter-agency feud with the FDIC and the Treasury Department. The Fed, along with the more bank-friendly Office of the Comptroller of the Currency, is resisting moves to craft rules cracking down on banks that charge illegal fees and carry out improper foreclosures. The FDIC supports such rules, according to an FDIC official involved in the dispute.

Got that?

The Fed and OCC are resisting cracking down on ILLEGAL fees and IMPROPER foreclosures.

What part of "illegal" don't these guys care about?

Oh, that's simple. If it's illegal (say, by charging an illegal fee, foreclosing by committing perjury, doctoring wire information so that the fact that you're funding terrorism in the Middle East is obscured, or screwing municipalities with hinky derivative deals, or perhaps not even transferring mortgages into alleged mortgage-backed securities) according to The Fed and OCC it's perfectly ok if it screws the consumer - or anyone except a bank.

But as soon as you screw a bank, why that's really illegal and for that you should be prosecuted.

Karl's rebuttal to Mish

http://market-ticker.org/akcs-www?post=175557

It's time to take a stand my friends.
It's imperative that you read and understand the bill that Dennis Kucinich has written for review.
While I respect Mish, I find myself in total agreement with Karl.
No this bill is not perfect, but what it does do is rope in those imperfections enough to allow them to be quarantined off from the constant infections to the rest of us.
Most of us don't live and breath Wall Street. We're just everyday people that would like a stable monitary base, one that doesn't erode every time Wall Street finds itself crapped out at the table, because once again they bet it all, and ended up rolling snake eyes. Which has happened so many times in the past that the pattern can be seen by a blind person.
The constant cry of "We didn't know" is nothing more than a bald face lie intended to sooth those gullible enough to believe it.
The common man is not sustained by the growth of interest, and yet his meager table is laid with interest aplenty, due to the fact that the fiat instrument (the federal debt note, or more commonly known as the dollar)hold less and less value (buying power)on a daily basis.
Our meager wage is now consumed by the constant of interests and fees, plied by those that reap rich rewards from the continuance of their usage.
Our daily lives have been financed due to our own lack of affordability to maintain it.
It's not from the want of high priced toys that the talking heads all blame it on, but more so from the daily maintenance that living takes, that sometimes calamity overrides, and when that does happen, taking out another loan is the only way most of us are able to continue treading the water of daily life. In other words consolidation of what ever train wreck just hit us.
Our parents and grandparents were so much more wealthy than we, because the value of their dollar was 100%. It was backed by the stability of gold, not debt like the way ours is now.
If "We" the common man are to survive, the system of monitary finance must be changed.
Man cannot live by paper pushing alone, it takes real substance to be nourished, when sitting down at the table of life. The table that was meant to nourish and sustain us all, not just a select few, as they would have you believe.

Of course if you're an "asset manager" you have a hell of a reason to like "small inflation", because that is what creates the dynamic that forces people to spend or take risk instead of saving, as savings are under such an inflationary system a sinking fund.

Dennis Kucinich: Delete The Fed

I'm stunned.

Really.

Dennis Kucinich, which many people have (properly) labeled as one step removed from a communist in the past, and who has a reputation as having a hard-core left slant in his politics, has just written up and introduced a bill that will fundamentally restore the free market - for real - to banking and credit.

It will also **** a lot of people off.

His bill would end the process of money issuance by The US Federal Government as a debt instrument. It would thus restore actual "lawful money" as Ron Paul claims to want, but in a form he has never, ever elucidated. It does, however, exactly match up with the base position I have propounded upon, along with Bill Still and a few others.

Instead, Treasury would issue and spend into circulation United States Notes. The existing "FOMC" would be replicated in Treasury with a mandate identical to The Fed's, with one important addition - a requirement that their operations be neither inflationary or deflationary.

That is, the precise mandate that is required - that United States Money maintain its purchasing power.

http://market-ticker.org/akcs-www?post=175610

The response from Shedlock to my previous missive on Kucinich's bill is amusing.

Denninger is not the only one who is stunned. I am stunned that anyone could support this preposterous idea, assuming they read it and are sober.

Neither sound money nor the free market comes from printing money into existence. Arguably the only thing worse than the Fed printing money out of thin air is Congress printing money out of thing for the purpose of full employment and/or any other absurd ideas Congress has.

As opposed to loaning it into existence at gunpoint (literally in the case of TARP, QE1 and QE2), as is done now?

The last thing we need, the very last thing we need is Congress lending money into existence to pay the bills or to do anything it wants for any reason. Those looking for hyperinflation can find the roots of it in that bill.

Might I remind Mish (or should I rename him as "Mush", as in "for brains") that the bill contains an explicit provision prohibiting that which he claims will happen?

November Retail Sales and PPI: Blech

http://market-ticker.org/akcs-www?post=174922

On the first day of Christmas
Look what Karl showed to me
A lie that the Census Bureau
Hid underneath the tree

Gotta love this....

The U.S. Census Bureau announced today that advance estimates of U.S. retail and food services sales for November, adjusted for seasonal variation and holiday and trading-day differences, but not for price changes, were $378.7 billion, an increase of 0.8 percent (±0.5%) from the previous month, and 7.7 percent (±0.7%) above November 2009. Total sales for the September through November 2010 period were up 7.8 percent (±0.5%) from the same period a year ago. The September to October 2010 percent change was revised from +1.2 percent (±0.5%) to +1.7 percent (±0.2%).

Let's look inside....

Here's the internal table... and it immediately demolishes the CNBS spin machine which said "Electronics are down, that's why BBY missed!"

That's a damned lie!

Best Buy: Oops (That's a Miss)

http://market-ticker.org/akcs-www?post=174917

Lol, check out Karl's re-write of Best Buy's CEO Brian Dunn's earnings report.
High five Karl, you rang the bell lol.

Best Buy (NYSE: BBY) went Bye-Bye and blew up this morning on a monster earnings miss.

Grandma got run over by a reindeer...... right through the hole in your same-store sales numbers!

Unit sales declined, same-store sales declined, profits missed.

But Christmas was going to be so gooooood!

Uh, no.

Same store sales down 3.3% over the last three months, including Black Friday? What happened to the CNBS claims that Black Friday was "excellent", "awesome", "Big Box stores all did good"?

Diluted EPS of 0.54 is basically identical to the last quarter's 0.53, which is horrifying given seasonality. Revenue was down as well.

Michael Savage: Home Run - And Boycott WalMart

http://market-ticker.org/akcs-www?post=174244

Home run Karl!
America this IS your mission.
Take it seriously, if you don't the repercussions could be rather serious for you.
By buying an alarm clock, batteries for your flash light, and fertilizer for your lawn, all at the same time, under Janet's new proposal, gets you an automatic red flag and reported.
Swat your kid on the butt in Walmart for being a brat gets you automatically reported.
Wear a hoodie......To many tattoos.....Piercings....
Your in for a pickup, because you scared someone.
Think about it!

The only thing I've ever seen in WalMart that would be considered dangerous or suspicious is the really nasty fart that had just been emitted from someone who spent too much time in the candy aisle.

Note that Napolitano is largely personally responsible for one of the actual threats in this country in the "homeland" in the form of all the illegal Mexicans she let across her border during her tenure - many of whom are drug gang members.

Governor Ridge and I have our differences in policy, but he was, at least, competent.

Napolitano is not competent to clean a toilet.

More BOA Attention (Of The Unwanted Sort)

http://market-ticker.org/

And the pooling and servicing agreement, which the borrower's counsel asked to have produced (to prove that all of the other things done were on the "up and up" was allegedly produced in court unexecuted and with the word "DRAFT" emblazoned over the top of it, after an attempt to find it on the SEC's EDGAR website proved fruitless.

DeMartini’s statements also place Bank of America’s outside auditor, PricewaterhouseCoopers LLP, in a tough spot. The firm has no choice now under U.S. auditing standards but to find out definitively if what DeMartini said is correct, and whether the answer would affect any of its prior audit conclusions. PwC billed Bank of America $128 million for its audit and other services last year. The mortgage at issue in the court ruling was originated in 2006 by Countrywide Financial, which Bank of America bought in 2008.

Auditors have never mattered since ENRON. In fact, basically all of them involved in auditing the financials of banks should be strung up by their nuts by now. How you can possibly argue that an audit opinion has merit after the disclosure of The Fed haircuts on the so-called "assets" pledged for TAF and similar programs at this point is beyond the pale. That is, we now know that banks came to these programs and pledged assets with ten times or more the face value of what they "borrowed" - but then when these loans were repaid those worthless assets (in the opinion of the NY Fed desk) were never recognized at that valuation by anyone ever again. In fact, they're probably still sitting on bank balance sheets - at 95 or even 100 cents on the dollar.

This much I can tell you with certainty - whatever collateral was pledged on 1/21/2009 in the "face" amount of $185 billion for a $15 billion loan was never exposed in a 10K or 10Q as having taken a loss of more than 90%.

Such a loss would have resulted in in the instantaneous detonation of Bank of America. Indeed, that loss is more than half of the firm's enterprise value as of today and exceeds the company's market cap.

That is, it was more than enough to blow them to Mars - and that was one transaction.

While some of those loans were clearly rollovers of earlier ones, and thus the "9 trillion" bandied about is a histrionic distortion (typical of many people in the media and Congress) the fact remains that these programs disclose monstrous hidden losses in the form of worthless collateral that was posted by these institutions and which then disappeared once again into their bowels and has not been seen since.

Jobs Report (See I Told You So!)

http://market-ticker.org/akcs-www?post=173913

And this my friends is why I offer up to you, Karl on a daily basis.
I'm not educated enough to understand the whys and whats of the spin that these reports are written in.
Karl is.
I bow to the master, because I want you to understand that the simplified truth of their version, is bullshit!
"WE" can't afford not to understand exactly what they're doing when they're manipulating these reports.
Because what's in these reports show the full truth of just how loud "OUR" death rattle actually is.

(Incidentally, someone needs to explain to these clowns that a dollar collapse that comes with a stock market collapse at the same time is a situation the monetary authorities cannot arrest with more "money printing", as that will simply tighten the spiral. I have warned of this risk for more than a year - God help us if it becomes realized.)

Those who follow me know that I pay almost no attention to the "headline" numbers in the report though. Why? Because they're full of hopium and BS. Instead, I look to the household survey, which is an actual count. What do we find there this month?

In a word: NASTY.

185,000 people were added to the working-age population (238530 to 238715). But the employed number actually fell by 334,000 people (139749 to 139415), which means that on an employed rate basis over 500,000 jobs were lost.

The claimed "improvement" was all adjustments - to the tune of 360,000 alleged jobs that households reported didn't exist!

Why did Florida's Republican Party hide the subpoena

http://www.miamiherald.com/2010/12/01/1952560/feds-subpoena-finance-records.html

This is only the Republican Party and it's only from the state of Florida, but what it is, is a sample of just how corrupt the political system has become.
You know as well as I do that every state from both parties has this very same kind of garbage going on.
And the benefactors of this garbage are running this country, the proof is in the pudding.
America your government, as well as your political system has head lice, and their nits are everywhere.
It's time to strip them out with the lice comb.

Hat tip to Karl Denninger as well as BloggyBayou for the find.

Federal investigators slapped the Republican Party with a subpoena seeking financial records as part of a wide-ranging corruption probe by the FBI, IRS and U.S. Attorney's Office, the Herald/Times has learned.

The subpoena, delivered Election Day, sought documents related to big spending by top Republican honchos who were given party-paid American Express cards.

Top RPOF officials and investigators declined comment on the federal probe or the subpoena.

For more than a year, the party has reeled from scandals tied to the credit cards as well as four unrelated state criminal probes into its former chairman, a fundraiser, a former Florida House speaker and a Capitol insider.

Federal investigators have already interviewed consultants, donors and numerous senators -- some in their Capitol offices. The investigations are being handled in multiple offices throughout the state, from Pensacola to Miami.

The specific targets of the recent subpoena are unclear.

Republican Party of Florida Chairman John Thrasher said he wasn't sure about the details of the subpoena and said he couldn't opine on them.

TSA Steals **A Child**

http://market-ticker.org/akcs-www?post=172947

Unbelievable and Karl's right check the date,it's over a year ago.
The piss off part is that only now, is MSM and Congress talking about it, and they still wouldn't be if not for the blogger brigade.
Do you realize what could have happened to this child?
Or for that matter, how do you know it didn't?
His Mother doesn't! And neither do we, because we know who the TSA employs,
Child molesters and rapists.
They don't screen their own but they will screen you.
It's time for an all out boycott of flying
If "WE" don't make a stand now, there will be no freedom left to make a stand for!

No, I'm not kidding.

My worst nightmare took place yesterday. Worse than events that have taken place and that I have survived in my short 28 years of living. Worse than my wildest of dreams could conjure.

My son was taken from me.

Taken.

My son was taken from me by the TSA agents at Atlanta Hartsfield-Jackson airport yesterday.

He was taken away from me and OUT OF MY SIGHT because his pacifier clip went off when I carried him through the metal detector.

According to the Transportation Security Administration website, “We will not ask you to do anything that will separate you from your child or children.”

Bull**** TSA.

You took my son. MY SON.

Go ahead folks.

Read the whole thing.

Defend that.

President Obama: Stop Lying (TSA)

http://market-ticker.org/akcs-www?post=172880

What Karl forgot to mention here is that our government was also video taping this man while he lit up his underwear!
Yes that's right, now ask yourself WHY they would do something like that.
From start to finish this was a setup to scare the piss out of you again, so Michael Chertoff (and George Sorros by the way) could make an extra boat load of money off those crappy naked scanners.
Hot damned if it didn't work to.
Homeland Security has gotta go. Who actually needs another procurement officer for the United States, we have enough of those already.
The FBI needs to take back it's rightful place and get rid of the Nazi's that stole it.
America haven't you had enough of being afraid of the boogeyman.

Listen very carefully Mr. President: You're on the wrong side of this.

Obama said he's told the U.S. Transportation Security Administration: "You have to constantly refine and measure whether what we're doing is the only way to assure the American people's safety. And you also have to think through, are there ways of doing it that are less intrusive."

At this point, that agency and counterterrorism experts have told him that the current procedures are the only ones that they think can effectively guard against threats such as last year's attempted Christmas-day bombing. A Nigerian man is accused of trying to set off a bomb hidden in his underwear aboard a flight from Amsterdam with nearly 300 people aboard.

Mr. President. Let's get something clear here.

First: That Nigerian boarded a flight into the US without a passport. He did so because someone from our Government overrode the protocol requiring that he have one, like everyone else. But for that act, which someone in your government took, he couldn't have gotten on the plane.

Timmy Lies Again

http://market-ticker.org/akcs-www?post=172845

Timmy actually thinks he or big Ben has credibility?...For real?
Coz from what I can see no one else does anymore, of course their change of tune might be just a simple case of CYA, which I'm pretty sure it is, due to the fact that a great many of them lined their own pockets off of the crap that Timmy, Hank, and Ben were and have been doing to lead the way back to safety for their bestest buddies at the investment banks.

How does the FED think it's going to create jobs? The only things I can see they're doing by monetizing the debt is
1)Trying to keep their own job,(If nobody buys Gov debt, there's not much left for them to do) as well as holding their bestest buddies heads above water so they don't drown in their own insolvency.
2)By monetizing the Gov debt it keeps all of those defense contractors working,( hey without them how would we be able to participate in the wars)
God knows our Military can't take care of itself anymore, and they even admit it. Which by the way is down right embarrassing, as well as a huge waste of money. It seems to me like it a double dip at this point, one or the other has to go. "WE" can only afford to keep one.
On a personal note I wonder, (because Timmy just shot his mouth off in talking down to the Republicans) how long he will get to keep his title?
You can't call it a job, because he takes no salary from the Treasury position. Which kind of has to make you wonder why the hell the government would allow him to make any decisions at all doesn't it?
It ain't like he works for us and can be held responsible.

Timmy Lies Again

You knew he couldn't keep his mouth shut, right?

U.S. Treasury Secretary Timothy F. Geithner said the Obama administration would oppose any effort to strip the Federal Reserve of its mandate to pursue full employment and warned Republicans against politicizing the central bank.

“It is very important to keep politics out of monetary policy,” Geithner said in an interview airing on Bloomberg Television’s “Political Capital with Al Hunt” this weekend. “You want to be very careful not to take steps that hurt our credibility.”

You have to have something in order to lose it.

The acceptable practice of lying in the "New World Order"

http://market-ticker.org/

As a good parent, most teach their children not to lie or cheat.
But with the advancement of the "NEW WORLD ORDER" to do so now leaves your child at a great disadvantage for their future earnings.
The top Talent of Wall Street's Investment Banking Scam Artists, seem now to be allowed to spit directly into the face any Judiciary they please with no questions asked.
To be a good parent now, one must instill the lesson of disobedience to not only the courts and laws they govern, but the laws of ethical behavior as well.
Very soon the position of law enforcement as well as the judicial system itself will become nostalgic relics of a long ago forgotten civilised society.
No law at all will be the order of the day
designed and enforced by the "NEW WORLD ORDER"
Dissenters of such order will all be sent back for reprogramming and if said reprogramming fails again, the consequences will lead to a termination of the subject.
Welcome to the mechanisms of the Machine called the
"NEW WORLD ORDER"

When Caught, Just Lie Some More!

Jesus....

Bank of America appears to have improved the state of the art in the creative foreclosure procedures department. I started hearing a few months ago about a sudden and suspicious increase in the number of foreclosures Bank of America was making in its own name. BofA was in effect saying that it owned these loans and had never securitized them. That seemed questionable, since the bulk of Bank of America’s mortgages had been originated by Countrywide, and Countrywide has said in its SEC filings that it securitized 96% of them.

Well that's easy - they never transferred crap. Now, with the payments not being made, they got a rather large problem in that department..... maybe a fatal one to their "wonderful" and "ethical" bank.....

1. Either Countrywide lied in its 2003 SEC filings or the loan was never on Bank of America’s books. Which would you believe?

2. Even though Countrywide appears to have intended to convey the loan to its CWABS 2003-BC6 trust, it appears never to have completed the steps. The assignments are legally void by virtue of being out of time and by being inconsistent with conveyance chain stipulated in the PSA (which would have been from Countrywide through at least one intermediary entity to the trust. So the trust does not now own the note either.

This means the odds are awfully high that Bank of America committed multiple frauds on the court, first on the state court in the foreclosures process, and now on the Federal bankruptcy court.

Naw, they'd never do anything like that, right?

The fun here of course goes to motive. Fraud upon a bankruptcy (and state) court is no small thing. It's one thing to "robosign" something that is technically correct but expensive to process correctly.

It's quite another to claim you own something when you don't - there the motive has to be that you'd get REALLY SERIOUSLY reamed if the truth were to come out.

Like, perhaps, that you still have all those notes in your files and never transferred any of them?

Well that could be a problem. In fact, it could be a really serious problem, because in this case the MBS holders bought nothing, you were paid in full, you committed fraud upon the MBS holders, and oh, incidentally, since you're the same person on both ends of the transaction now we have really big problems because the entire "arms length" thing goes up in smoke too, and that's one of the requirements to get "holder in due course" status.

How bad could this be? It could be very bad. It could be in aggregate hundreds of billions of dollars of notes that are - surprise-surprise - really owned by Bank of America (cum-Countrywide) and the losses thereupon could land on them, instead of on the MBS holders.

There is more than enough there to blow Bank of America (and all the other banks that pulled this crap) to well beyond the orbit of Mars - in tiny little pieces.

There also is enough (if we had an honest judicial system) to bring criminal and civil fraud and racketeering charges against literally everyone involved, since these acts would be hard evidence (if not proof) that the original acts were deficient and this is nothing more than an attempt to cover it up.

If you're curious as to why there are rumors floating around about an attempt to pass an ex-post-facto law that is clearly unconstitutional on its face, you shouldn't wonder why they'd try that any more.

This needs to be forced into the open now and both criminal and civil sanction applied to each and every act of deception and fraud that is found.

STOP ARGUING OVER THE "FREE HOUSE" CRAP. IT IS QUITE APPARENT THAT THERE ARE LITERALLY MILLIONS OF INSTANCES OF FRAUD COMMITTED BY THESE INSTITUTIONS AND NOT ONE HAS BEEN INVESTIGATED AND PROSECUTED AS SUCH.

STOP THE LOOTING AND START PROSECUTING - NOW!

PS: I wonder if this is an example of what Greenie was talking about?

What We Need For True Change

http://market-ticker.org/akcs-www?post=171835

You either go about protesting "OLD SCHOOL" or you just might as well as shut the fuck up and take what the governments giving you right up the ass.
Bodies need to be on the street day and night right up in their face or your protest is nothing but a cocktail party piece of conversational amusement.
Is that what you want to be seen as America, nothing more than a joke?
Because that how all of your protests look not only to the government but to the rest of the world as well.
Either get serious and put your back into it on a 24/7 basis or just forget the whole thing and suffer in silence.

You've seen the 9/12 Rallies.

The Glenn Beck Rally.

The Strewart Rally.

And none of them have done a thing to influence Washington DC policy, have they?

Nope.

Nor will they.

Why?

Because you go home the same day.

President Obama, The Senate, Congress, Ben Bernanke - they look out their window and they see you. Or do they? Well, no. You time the rally to be convenient for you. It's on a weekend. They're not at work.

You're preaching to an empty church!

Oh yeah, they know you're there. So what?

The next morning they go to work and you're gone. You've gone home. You made your "Statement", such as you claim it, and that's all.

You're ignored because there's nothing uncomfortable for them in what you did.

Now contrast that with MLK. He literally got in the administration's face. He rallied, he protested, and he did it daily. He didn't speak and then go home, he spoke and then came back the next day and waved more signs!

The Press Continues To Wake Up

http://market-ticker.org/akcs-www?post=171792

Are you there yet America?
Mad enough to take your country back?
Or are you willing to settle for a life with "no rule of law"?
We're not children to be ruled over for our own safety, without mind or experience enough to understand that whats being meted out is no longer for the benefit of our welfare but for that of those that would abuse us.
It's time for the last curtain call on this show and to end the wealth of it's run.

If you were wondering if the Federal Government was engaged in a conspiracy (yes, that word) with the large banks to steal houses, you no longer need to wonder.

It is .

But even as it closed the door on state oversight, the OCC chose itself not to scrutinize the foreclosure operations of the largest national banks, forgoing any examination of their procedures and paperwork. Instead, the agency relied on the banks' in-house assessments. These provided no hint of the problems to come until they had tripped the nation's housing market, agency officials later acknowledged.

Dateline: 2007.

Where have we seen this before? Oh yeah: When the OCC went to court with the backing of the Bush Administration to block enforcement of state predatory lending laws.

That's right folks: The so-called "regulators" regulated your right to a fair deal - they made sure you didn't get one. They knew the banks were cheating and playing games - effectively robbing the people - and not only did nothing, they blocked the states from putting a stop to it.

Now can someone tell me, once again, why we as Americans continue to respect the Federal Government?

And don't give me this crap about "they have guns."

I remind you that in the 1960s and early 70s the government had lots of guns too, and yet the people effectively forced the government to withdraw from Vietnam.

When the people of this nation - hundreds of thousands of them - are willing to lay peaceful siege to Washington DC - to be "in their face" every single day without fail, refusing to leave, being in the face of every Congressman, every Senator, every FOMC and Federal Reserve Board Governor, every OCC employee - at their office, in front of their house, where they appear to give speeches - then, and only then, will the banks robbing people stop.

Just 1/2 of 1% of the population of this nation would be over 1.5 million people.

We get robbed because we, thus far, are consenting.

We get robbed because not even 1/2 of 1% of the population will rise and demand that it stop, the banks involved be closed and their executives prosecuted - being "in their face" - on a literal daily basis until it does.

The Disease That Is America

http://market-ticker.org/akcs-www?post=171582

PT Barnum once said there was a sucker born every minute. That was a long time ago, and it would seem that the suckers, having no one else left to procreate with except themselves, have now left the nation utterly incapable of realising the depths of the rational thought process.
Karl proves this point perfectly, or rather I should say the comments on Karl's blog have.
Not one comment stated, what should have been the obvious, that Palin, as well as the rest of the Tea Party, have left out of their political platforms.
The over taking of "OUR" Nation and the enslavement of "OUR" people through the economic art of embezzlement, by the actions of Ben Bernanke for the further empowerment of the Federal Reserve, or by Timothy Geithner's misuse of the United States Treasury for furthering the agendas of his honorary governorship of the IMF.
All the tits and ass in the world will not be distraction enough for what Ben and Timmy have done and are now currently continuing to do, through the process of QE2, for the total debasement, of any type of buying power for the dollar.
Starvation can be a real eye opener, but by then it will be to late to do anything about it.
America you must ban together and take back your nation now, or there is NO FUTURE for you or your children, other than that of Zimbabwe, where a loaf of bread, if you can afford it, cost 10 thousand dollars.

My my my, what lovely sheep you are.

Last night I posted a commentary that Sarah Palin will be delivering today.

She, like all modern politicians, reads from a teleprompter. Wow. I'm impressed. For the record, in all of my public-speaking engagements, I've never used one. Even when it was offered. I don't believe in them.

20, 30, 40 or more years ago, there wasn't one. I will sometimes bring a set of cue cards with me to the podium, and others have historically done that as well. In my view, if you can't orate from your mind, you can't orate. Anyone can stuff a suit or a blouse - witness the bubbleheads on TV every day.

Are you selling your words? Or are you selling your **** - or penis?

(Get over it folks - sex sells and always has. When was the last time you saw an ugly TV news anchor?)

Nonetheless, I want to focus this commentary on the responses to that Ticker.

They're not only sad, they're a reflection of us. Some short excerpts:

GMAC Sued In Federal Court - 42 USC 1983 (!)

http://market-ticker.org/akcs-www?post=171519

Oh look what Karl Found!
The heavy hitters are gunning for GMAC!
And the best part is, they shoot straight and don't miss.

Uh, this is going to be interesting......

The “technical” problems and other issues seen in foreclosure courtrooms across this country are merely symptoms of much larger issues that impact our broader economy and in fact our national security and the economic survival of this country.

Yep.

We should have learned during the 2008 economic collapse that the the entire subprime mortgage industry was an unregulated, unchecked fleecing of the entire country. We did not learn, instead we bailed out the con artists and criminals and there were no consequences for this fundamental breakdown. Next, we shoveled more money at the criminals and con artists during the Modification Madness of 2009 and 2010.

Why of course. We've already discovered that "HAMP" played right into the PSAs that made foreclosing a racket - a very profitable racket.

The only hope we have is that passionate and ethical attorneys will stand up and fight against the tyranny of the big monied interests through class action lawsuits. It’s time for a popular uprising, for consumers to join together and fight for the principles of justice and the rule of law.

Well, that's not the only hope. It may be the only peaceful hope, and the one that we all pray takes place. I'm not very confident, unfortunately.

Note that this is a particularly-nasty suit, in that it invokes 42 USC 1983 - Deprivation of Rights under color of law or authority. I presume the argument here is that GMAC is effectively an arm of the federal government. That ought to be nice.

The entire complaint is well worth reading. In addition, this isn't a hack-job legal outfit - pay close attention here folks as the Mason Law Firm of DC is involved.... and they're quite-well known for nailing people to the cross when systematic screwing has been practiced by an industry.
