California Governor Signs Marijuana Decriminalization Bill

Pot wins by default, they can't afford to prosecute it anymore.
All the money spent for prosecuting it for the prize the price of a traffic fine.
Common sense prevailed.
Arnold should fully legalize it and tax it for purchase.
It would definitely open up a new employment fields.


California Gov. Arnold Schwarzenegger (R) Thursday signed into law a bill that decriminalizes the possession of up to one ounce of marijuana. The bill reduces simple possession from a misdemeanor to an infraction.

Under the bill signed today, SB 1449, by Sen. Mark Leno (D-San Francisco), pot possession will be treated like a traffic ticket. The fine will remain at $100, and there will be no arrest record.

"The only difference is that because it is a misdemeanor, a criminal defendant is entitled to a jury trial and a defense attorney. In this time of drastic budget cuts, prosecutors, defense attorneys, law enforcement, and the courts cannot afford to expend limited resources prosecuting a crime that carries the same punishment as a traffic ticket."

Prohibition - the worst mistake our federal government ever made when it came to restraining freedom, in that all it did was provide the fuel for criminal gangs to buy weapons, bullets and harm lots of innocent bystanders - was ended by The Depression and a need for tax revenues.

Now California in the crunch of a massive budget deficit is considering the first act of sanity in a nearly-100-year old drug war that has similarly done nothing to promote general societal welfare, but has locked up hundreds of thousands of non-violent Americans who have engaged only in consensual adult transactions and acts, wasted hundreds of billions of dollars, fueled wars in foreign nations and provided the money that criminal gangs in the United States have used to buy weapons with which they have terrorized the population.

I am speaking of Assembly Bill 390 - The Marijuana Control, Regulation, and Education Act.

From the summary:

This bill would remove marijuana and its derivatives from existing statutes defining and regulating controlled substances. It would instead legalize the possession, sale, cultivation, and other conduct relating to marijuana and its derivatives by persons 21 years of age and older, except as specified. It would set up a wholesale and retail marijuana sales regulation program, including special fees to fund drug abuse prevention programs, as specified, to commence after regulations concerning the program have been issued, and federal law
permits possession and sale consistent with the program. It would ban local and state assistance in enforcing inconsistent federal and other laws relating to marijuana, and would provide specified infraction penalties for violations of these new marijuana laws and regulations, as specified.

It's about damn time.

Never mind that there's a lot of use for the hemp plant that has nothing to do with getting stoned

Selective ethics,
Right or wrong has not changed in the fact that smoking is not good for you, they have taxed tobacco till it can hold no more, so morals are put aside to now allow
"The legal Sale" and "Condoned Usage" of marijuana as a fresh new tax avenue.
There not doing this out of a sense of common sense, nor are they doing it to appease "The People" They are doing this because IT IS the only thing they can do to semi stay afloat.
In time it would actually rate an advantage as a business draw.

Lawmakers consider bill to allow pot for pleasure


Lawmakers on Tuesday approved Assembly Bill 390 -- legislation to tax and regulate marijuana. The Assembly's Public Safety Committee voted 4-3 on bill at a hearing in Sacramento. The bill will now be passed to the full Assembly on Friday for consideration.

The bill, authored by San Francisco Assemblyman Tom Ammiano, would essentially treat pot the same way alcohol is treated under the law and would allow adults over 21 to possess, smoke and grow marijuana.

The law would also call for a fee of $50 per ounce sold and would help fund drug eradication and awareness programs. It could help pull California out of debt, supporters say, raising up to $990 million from the fees.
